Making Accommodations for a Person’s Religious Practices

Both federal law and the California Fair Employment and Housing Act (FEHA) protect workers from discrimination and also require employers to reasonably accommodate an employee’s religious beliefs or practices. Accommodations may include schedule or shift changes for religious observance or allowing an employee more flexible break times during which to pray. Additionally, the California Workplace Religious Freedom Act expand FEHA to specifically provide an employee with the right to wear religious garments such as head or face coverings, wear religious jewelry, or refuse to wear short skirts or pants in accordance with religious beliefs. The new Act also protects an employee’s right to certain religious grooming practices, such as wearing long hair, facial hair, or body hair.

In Los Angeles, employers must reasonably accommodate religious beliefs and requests unless the request would cause undue hardship or cause health or safety concerns in the workplace. An employer also has the ability to withhold pay for additional time off for religious observance.
