Religious Discrimination in the Workplace
Both federal and state laws protect employees from discrimination or harassment based on sincerely held religious beliefs or practices. In LA, an employee’s religious beliefs should never be considered in employment decisions or deciding whether an employee can do a certain job. Additionally, employees who suffer religious discrimination in the workplace often suffer illegal harassment or a hostile work environment.
If you believe you have been the victim of unlawful harassment or discrimination based on your religion, you should consult with a Los Angeles employment law attorney as soon as possible. Our team of attorneys has approximately 40 years of combined experience with employment law cases and we can advise you on every aspect of a religious discrimination case.
Making Accommodations for a Person’s Religious Practices
Both federal law and the California Fair Employment and Housing Act (FEHA) protect workers from discrimination and also require employers to reasonably accommodate an employee’s religious beliefs or practices. Accommodations may include schedule or shift changes for religious observance or allowing an employee more flexible break times during which to pray. Additionally, the California Workplace Religious Freedom Act expand FEHA to specifically provide an employee with the right to wear religious garments such as head or face coverings, wear religious jewelry, or refuse to wear short skirts or pants in accordance with religious beliefs. The new Act also protects an employee’s right to certain religious grooming practices, such as wearing long hair, facial hair, or body hair.
In Los Angeles, employers must reasonably accommodate religious beliefs and requests unless the request would cause undue hardship or cause health or safety concerns in the workplace. An employer also has the ability to withhold pay for additional time off for religious observance.
Employment laws regarding religious discrimination are complicated and often updated, such as the relatively new Workplace Religious Freedom Act in California. At HKM Employment Attorneys we know it is highly important to keep up with changes in the law and court decisions in employment discrimination cases. We have extensive experience in both bringing discrimination claims on behalf of employees and defending unfounded discrimination claims for employers.
